RIGHT TO RETRACT
Pursuant to article L.121-21 (law of 17 March 2014 on consumption) of the consumer code, the Buyer has 14 days from the delivery of the Work to put implement its right of withdrawal from the Seller, free of charge and without reason.

The Buyer exercises his right of withdrawal from JA by sending an email to the following address Jamesarax@gmail.com. JA will then deal with the Buyer's request for withdrawal and will refund it within 14 days of the date on which He was informed of the exercise of the Buyer's right of withdrawal.

The reimbursement will relate to the price of the work paid by the Buyer as well as the return costs.

Works returned damaged or soiled by the Buyer will not be taken back or refunded, JA reserving this choice at its sole discretion.

In accordance with the law, the customer has a period of 14 (fourteen) working days to return, at his expense, the products which do not suit him. This period starts from the day of delivery of the order.
Only items returned complete, in their original packaging intact (unopened blister pack), and in perfect condition for resale will be accepted. Any product that has been damaged or whose original packaging has been damaged, will not be refunded or exchanged.

This right of withdrawal is exercised without penalty, the customer only bearing the shipping and return costs.

The customer can request either the reimbursement of the sums paid excluding shipping costs, or the exchange of the product. In the case of an exchange, the shipping and return costs will be borne by the customer.

LEGAL GUARANTEES
JA undertakes to respect and implement the legal guarantees from which the Buyer benefits, namely: the guarantee of non-compliance and the guarantee of hidden defects.

ATWORKS GUARANTEES
In the rare event that a work of art arrives with a result different from that described, we will endeavor to obtain a return, refund, restoration or exchange. The JA team will always keep you informed of the progress of your request and will do everything possible to offer you the solutions that suit you best.

You must report the problem to JA team within one week of receiving the artwork. Provide any requested photographic evidence regarding the issue (including the original artwork and packaging).

The warranties cover the following issues

- You receive a damaged work
- A work is declared lost or damaged by the carrier
- An artwork has a different color from the one you ordered
- The work is delayed

FORCE MAJEURE
The existence of a case of force majeure may suspend the execution of the contract or, if it is final, result in the resolution of the sale.
Expressly, are considered as force majeure or fortuitous events, those usually retained by the case law of French courts and tribunals, i.e. an event beyond the control of the debtor, which could not be reasonably foreseen at the time of the conclusion of the contract and of which the effects cannot be avoided by appropriate measures
The party invoking Force Majeure must immediately notify the other party, as well as of its disappearance.

INTELLECTUAL PROPERTY
The Seller guarantees that he is the author of the transferred Work, that the Work does not in any way contravene the laws, regulations and standards in force and that it does not infringe the rights of third parties.
During the sale, the Seller transfers to the Buyer the material support for the work and its rights of representation over the work.
However, the Seller retains the moral right to the work sold as well as the rights related to its reproduction.

CERTIFICATE OF AUTHENTICITY
Once the order has been paid, the artwork(s) will be accompanied by a certificate of authenticity with all the elements relating to the work: Title, Description, Size, year of production, format, indication of the artist's signature, artist's signature on the document.

APPLICABLE LAW
These general conditions of sale are governed by French law.

MEDIATION
In the event of a dispute, the Purchaser has a right of recourse to a consumer mediator with a view to the amicable resolution of any dispute relating to the execution of these T & Cs, as provided for in Articles L.611-1 and following as well as R.612-1 and following of the Consumer Code.

COMPETENT JURISDICTION
Any dispute concerning the validity, interpretation or execution of these General Conditions of Sale must be brought before the courts of Paris.
